1. Acceptance of Terms

By accessing or using SkillStake ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. The Service is operated by SkillStake ("we," "us," or "our").

2. Description of Service

SkillStake provides a software platform that enables businesses and individuals ("Operators") to create, manage, and process payments for skill-based prize challenges. SkillStake is a technology platform and does not itself operate any challenges or contests.

3. Operator Responsibilities

As an Operator using SkillStake, you are solely responsible for:

• Compliance with all applicable local, state, and federal laws regarding prize contests and games of skill
• Obtaining necessary permits, licenses, or insurance for your challenges
• Ensuring your challenges qualify as games of skill (not games of chance) in your jurisdiction
• Accurately representing challenge rules, odds, and prizes to participants
• Timely payment of prizes to winners
• Maintaining adequate funds to cover potential prize payouts
• Participant safety during physical challenges

4. Participant Terms

Participants in challenges hosted on SkillStake agree that: entry fees are non-refundable once a challenge attempt has been made; results are determined by skill, not chance; operators set and enforce challenge rules; and disputes are between the participant and the operator.

5. Payments & Fees

All payments are processed through Stripe. SkillStake charges a monthly subscription fee based on your selected plan. Standard Stripe processing fees apply to all transactions. Subscription fees are billed monthly and are non-refundable except as described in our 30-day money-back guarantee for first-time subscribers.

6. Prohibited Uses

You may not use SkillStake to:

• Operate games of chance, lotteries, or gambling activities
• Conduct fraudulent or deceptive challenges
• Violate any applicable law or regulation
• Operate challenges involving minors without parental consent
• Misrepresent odds, rules, or prize amounts

7. Intellectual Property

The SkillStake platform, including all software, design, and content, is owned by us and protected by intellectual property laws. You retain ownership of your challenge content and data.

8. Limitation of Liability

SkillStake is provided "as is" without warranties of any kind. We are not liable for any damages arising from your use of the platform, including but not limited to: financial losses from challenge operations, legal issues from non-compliance with local laws, or participant injuries during physical challenges.

9. Termination

We may suspend or terminate your account at any time for violation of these terms. You may cancel your subscription at any time through your dashboard. Upon cancellation, your access continues through the end of your current billing period.

10. Changes to Terms

We may update these terms at any time. Material changes will be communicated via email or through the platform. Continued use after changes constitutes acceptance.
